Effective judicial management of disclosure issues protects trial fairness while keeping proceedings focused and proportionate. This training examines the principles established in R. v. Stinchcombe, R. v. McNeil and related authorities from the perspective of the presiding judge.

Learning objectives:

- Identify the legal framework governing first-party disclosure, police misconduct information and applications for third-party records.
- Distinguish a genuine disclosure dispute from disagreements about admissibility, weight or trial strategy.
- Create a clear record, set workable timelines and address privilege, privacy and safety concerns.
- Ensure that self-represented accused understand the right to disclosure and have a fair opportunity to access and use it.
- Select remedies that respond to the nature, timing and prejudice of a breach while protecting the integrity of the proceeding.

The course uses case-management and hearing scenarios to explore late disclosure, missing material, credibility information, adjournments and other remedial options. Judicial independence, governing legislation and binding appellate authority remain controlling.
