Meaningful disclosure review is central to competent defence preparation. This training helps defence counsel obtain, organize and assess the Crown’s production, identify material gaps and raise disclosure issues efficiently while protecting sensitive information.

Learning objectives:

- Make an early disclosure request and track what has been received, promised, withheld or identified as unavailable.
- Assess the material in light of the charge, reasonably available defences, witness credibility and investigative reliability.
- Identify potentially relevant police misconduct information and frame focused follow-up requests under R. v. McNeil and related authorities.
- Distinguish first-party disclosure from third-party records and select the correct procedure for each.
- Preserve a clear record of requests, responses and prejudice, and raise unresolved issues at the appropriate time.

Practical exercises address large electronic productions, missing notes or recordings, redactions, late disclosure and continuing disclosure. Counsel must safeguard disclosure, comply with court orders and professional obligations, and avoid using sensitive material for an improper or collateral purpose.
